The Mumbai Police has told the Bombay High Court that after conducting an investigation, they have taken a decision to file a ‘C’-Summary Report before a Magistrate Court in a complaint filed by Indian Revenue Services (IRS) officer Sameer Wankhede.
A ‘C’-summary report is a police report that an Investigating Officer files with a Judicial Magistrate. It’s a type of summary report that can be filed in criminal cases.
Wankhede had approached the High Court seeking to know the steps taken in the FIR registered by him in 2022 against NCP (Ajit Pawar) leader and former Maharashtra cabinet minister Nawab Malik.
The FIR was registered at Goregaon Police Station, and through the petition Wankhede had also sought a direction to the investigating agency to add some sections of the Scheduled Castes and Schedules Tribes (Prevention of Atrocities) Act against the persons named in the FIR.
Section 3 of the Act criminalises acts of humiliation, intimidation, and other atrocities against members of Scheduled Castes and Scheduled Tribes. Wankhede had sought to invoke some sub-sections of this section.
Wankhede in his plea had further sought a direction to the police to submit the steps taken by the investigating agency pursuant to the FIR registered at his behest.
On December 12, 2024, the state informed the court that Sections 3(1)(p), 3(1)(q) and 3(1)(r) of the SC/ST Act were added to the 2022 case and some time was sought to submit a status report of the investigation carried out.
However, this month, Additional Public Prosecutor SS Kaushik informed the court that the police, after conducting an investigation, have taken a decision to file a ‘C’ Summary Report before the court concerned.
The bench of Justices Revati Mohite-Dere and Dr Neela Gokhale, after hearing the prosecution, said that, “Nothing survives for consideration in the present petition. The same is disposed of accordingly.”
The bench also observed that Wankhede can take appropriate steps before the appropriate forum, like filing a protest petition before the Magistrate court against the closure.
Wankhede has been at loggerheads with Malik since 2021, when he was the Zonal Director of Narcotic Control Bureau (NCB) in Mumbai.
In January 2021, Malik’s son-in-law was arrested by Wankhede’s team for allegedly investing in the drugs business. Malik had then started a campaign against Wankhede, speaking about his religion, marital life and even his educational qualifications.
When actor Shah Rukh Khan’s son Aryan Khan was arrested by Wankhede’s team in October 2021, Nawab Malik had put out several social media posts highlighting the many flaws in the case. Ultimately, Aryan Khan was not chargesheeted by the NCB.
